Bad Influence Creative is a trading name of Bad Influence Industries Ltd (“BIC”, “we”, “us” or “our”). Bad Influence Industries Ltd is registered in England and Wales under company number 17068422. Our registered office is Preston Park House, South Road, Brighton, England, BN1 6SB. We are the controller of the personal information described in this notice.
We deliberately keep our data footprint small. For standard creative services, we ordinarily need only client and business-contact information, project information, approvals, correspondence and accounting records. We do not want or require client-customer databases, mailing lists, CRM exports, customer purchase histories or other unnecessary third-party personal data.
We may collect your name, role, business name, business contact details, enquiry and project correspondence, briefs and approvals, invoice and payment information, and information you choose to provide when you contact or work with us. We may also receive business contact information from referrals, company websites, social-media platforms or other publicly available professional sources. Limited technical or security information may be generated by our website hosting or security providers.
For standard BIC services, please do not send customer lists, CRM exports, mailing lists, customer profiles, purchase histories, special-category data, passwords or other unnecessary personal data relating to your customers, employees or other third parties. Where audience information is useful, please provide aggregated, anonymised or non-identifying information wherever reasonably possible. If identifiable third-party data is genuinely required for a project, this must be agreed with BIC before the data is supplied.
We use personal information to respond to enquiries, prepare quotations, take pre-contract steps, deliver agreed services, communicate about projects, manage approvals, issue invoices and process payments, maintain appropriate business records, comply with legal obligations, protect our business and manage ordinary client relationships.
Depending on the circumstances, our lawful bases are: steps taken at your request before entering into a contract; performance of a contract; compliance with legal obligations; and our legitimate interests in running, developing and protecting BIC, communicating with business contacts and maintaining proportionate business relationships. Where consent is legally required, we will rely on consent.
We may use relevant business contact information to market BIC’s own services where permitted by UK data protection law and the Privacy and Electronic Communications Regulations (PECR). You can object to direct marketing at any time by contacting us or using any unsubscribe option provided.
BIC may use AI-assisted and other technology tools in creative production. We do not intentionally upload client-customer personal data or other unnecessary third-party personal data into generative AI systems. Where business or project information is processed by technology providers, we seek to minimise the information shared and use it only where reasonably necessary for the service.
We do not sell personal information. We may share limited information with service providers used for email, hosting, cloud storage, accounting, payment processing, security or business administration; with professional advisers such as accountants, insurers or legal advisers; with employees, freelancers or subcontractors who reasonably need information to deliver a project and are subject to appropriate confidentiality obligations; or with regulators, courts, law-enforcement bodies or other authorities where required by law or reasonably necessary to establish, exercise or defend legal rights.
Some technology or service providers may process information outside the United Kingdom. Where this happens, we take reasonable steps to ensure that the transfer is permitted under UK data protection law and that appropriate safeguards are used where required.
Enquiries that do not become clients are normally kept for up to 12 months after the last meaningful contact, unless there is a reason to retain them longer. Client, contract and project records are normally retained for the duration of the relationship and then for up to 6 years where reasonably required for contractual, legal, tax, insurance or dispute purposes. Accounting and transaction records are kept for the period required by applicable law. Marketing records are kept until you opt out or we determine that retention is no longer justified. Unrequested third-party personal data will be deleted or returned as soon as reasonably practicable where we do not need it.
We take reasonable organisational and technical steps appropriate to the size and nature of BIC to protect personal information against unauthorised access, loss, misuse or disclosure. Access is limited to people and providers who reasonably need it. Where secure delegated or role-based access is available, please use that instead of sending passwords.
Depending on the circumstances, you may have rights to access your personal information, correct inaccurate information, request erasure or restriction, object to certain processing and receive certain information in a portable format. Where we rely on consent, you may withdraw it at any time. You have an absolute right to object to the use of your personal information for direct marketing.
BIC does not use personal information to make solely automated decisions about individuals that produce legal or similarly significant effects.
This website is currently intended to operate without non-essential advertising, profiling or behavioural-tracking cookies. If analytics, advertising pixels, embedded third-party tools or other non-essential technologies are added later, we will update this notice and introduce any consent controls required by law.
If you have a concern about how we use personal information, please contact us first at hello@badinfluencecreative.com. You also have the right to complain to the Information Commissioner’s Office (ICO), the UK’s data protection regulator.
We may update this Privacy Notice when our services, technology, legal obligations or data practices change. The current version will be made available on this website.
